These Terms and Conditions for In-App Purchases ("Terms") constitute our agreement between you and Convosique Pty. Ltd. ("the Company") regarding your use of in-app purchases within the Boundaries Health Check app ("the app").

This In-App Purchase Terms and Conditions is an integral part of the broader agreement between you and Convosique Pty. Ltd., as outlined in the Terms and Conditions of Service and Privacy Policy governing your use of the Boundaries Health Check app. By accepting these In-App Purchase Terms and Conditions, you also accept, acknowledge, and agree to the broader agreement.

By making an in-app purchase, you acknowledge that you have read, understood, and fully agree to be bound by all of these Terms. If you do not agree to any of these Terms, then you agree to refrain from making any purchases within the app.
When making an in-app purchase, you agree to comply with everything described here, without exception.

1. In-App Purchases:

1.1. What are In-App Purchases?: In-app purchases refer to any digital content, virtual goods, subscriptions, or other items available for purchase within the Boundaries Health Check app.

1.2. Authorization: By making an in-app purchase, you authorize the Company to charge your chosen payment method for the associated cost.
1.3. User Representations: You represent and warrant that you are legally authorized to make purchases using the chosen payment method and that you are at least [age requirement] years of age or have obtained parental consent to make the purchase.

1.4 In-App Browser Purchases: When using a link to a website from within the app, or when using an embedded webpage to make a purchase within the app, those kinds of transactions are governed by the third-party with whom you are making the purchase; it is not governed by the Company and you agree to not hold the Company responsible in any way for any reason whatsover.
2. Pricing and Payment:
2.1. Prices: Prices for in-app purchases are displayed in the app and are subject to change without notice.
2.2. Payment Methods: You agree to provide accurate and complete payment information, and you authorize the Company to charge your chosen payment method for the total purchase amount, including any applicable taxes.
2.3. Fraudulent Activity: The Company reserves the right to refuse or cancel any in-app purchase if fraudulent activity is suspected. In such cases, the Company may also take legal action as deemed necessary.
3. Plans and Subscriptions:

3.1. Plan and subscription Terms: If you purchase a plan or a subscription within the app, you agree to the terms and conditions specific to that subscription as described on the purchase page where you press the button to proceed with payment. You agree to the duration, renewal, and any related cancellation policies or other policies covered in the Terms and Conditions of Service.

3.2. Auto-Renewal: A "plan" is a one-time payment, as opposed to a "subscription," which is an automatically reoccurring charge. If or when subscriptions are offered in the app and you proceed with payment, then subscriptions may automatically renew unless canceled before the end of the current subscription period. You are responsible for managing your subscription settings to avoid unwanted charges.

4. Refunds:​

4.1. Refund Policy: All in-app purchases are final and non-refundable, except as required by applicable law or at the Company's sole discretion.

4.2. Chargebacks: In the event of a chargeback initiated by you or your financial institution, the Company reserves the right to suspend or terminate your access to in-app purchases and pursue reimbursement for any associated costs or damages.
5. Terms and Conditions of Service:

5.1. Subservience: These Terms for in-app purchases are subservient or subject to the Terms and Conditions of Service for the app. In the event of any conflict or inconsistency between these Terms and the Terms and Conditions of Service, the latter shall prevail.
5.2. You agree with all terms described in the Terms and Conditions that are relevant to your purchase experience and which may not be listed in this "In-App Purchase Terms and Conditions". For example, a more thorough Limitations of Liability section appears there, which applies to this agreement.

6. Limitations of Liability:

6.1. Disclaimer: To the fullest extent permitted by law, the Company shall not be liable for any damages, losses, or expenses arising out of or in connection with your use of in-app purchases, including but not limited to direct, indirect, incidental, consequential, or punitive damages.

6.2. Indemnification: You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to your breach of these Terms or your use of in-app purchases.
7. Governing Law:

7.1 These terms and conditions are governed by the laws of Queensland, Australia. Users agree that any dispute arising from or related to the use of the app shall be governed by the laws of the courts of Queensland, Australia and subject to the exclusive jurisdiction of the courts therein.
